US Court Orders Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling allegations, he was held in immigration custody.
In her decision, the judge pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The court challenge involve disputed assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in Tennessee.
Terms of Freedom
The judge, who was hearing his challenge to deportation in a Maryland district court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This decision marks a significant development in a complicated legal case involving claims of wrongful detention and contested gang affiliations.
